In North Carolina, domestic violence can be addressed as either a civil or a criminal action. Most importantly, North Carolina does not have criminal law codes that address violence based on domestic relationships.

Domestic violence charges can be categorized in two categories – misdemeanor and felony. A misdemeanor domestic violence charge can result in a sentence of up to two years in prison plus fines.  These misdemeanor crimes include:

  • Assault and battery
  • Assault of female
  • Assault of a child
  • Injury to a pregnant woman
  • Communicating threats
  • Assault with a deadly weapon

Felony domestic violence charges can result in decades of incarceration and fines. Felony charges include:

  • Sexual offenses
  • Nonfatal strangulation

In North Carolina, a police officer can only make an arrest if an act of violence was witnessed. If not, the victim will have to meet with a court official and discuss the details of the complaint and decide which charges should be filed.
